Bounce House Liability Waiver and Release of Claims

State of Colorado

This Liability Waiver and Release of Claims (“Agreement”) is entered into by the undersigned participant (or the parent/legal guardian of a minor participant) in favor of Maximum Elevation Inc., Mark Ewell, Kristin Bolander, and The Glen Metropolitan District (collectively referred to as the “Released Parties”).

Assumption of Risk

I acknowledge that participation in activities involving an inflatable bounce house involves inherent risks, including but not limited to: falls, collisions, entanglement, improper use of equipment, equipment malfunction, and other risks of serious injury or death. I voluntarily assume all risks, known and unknown, associated with participation.

Release and Waiver

In consideration of being allowed to participate in bounce house activities, I, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby release, waive, discharge, and hold harmless the Released Parties from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any injury, illness, damage, or loss that may occur while participating, whether caused by negligence or otherwise, to the fullest extent permitted by Colorado law.

Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, or expenses (including attorney’s fees) arising from my participation or the participation of my minor child(ren).

Medical Treatment

I authorize the Released Parties to provide or arrange for emergency medical treatment as deemed appropriate, and I release them from any liability for such decisions.

Rules of Use

I agree to follow all safety instructions and rules provided by the Released Parties and/or their representatives, including but not limited to:

• No shoes, sharp objects, food, or drinks inside the bounce house.

• No flips, wrestling, or rough play.

• Adult supervision is required at all times.

• Maximum occupancy and weight limits must be observed.

Severability

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado.

Acknowledgment of Understanding

I have read this waiver and release, fully understand its terms, and sign it freely and voluntarily. I understand I am giving up substantial legal rights by signing.
